5. Learnerships

5.1Establishment of learnerships

 

The Authority may establish a learnership if:

5.1.1The learnership consists of a structured learning component.
5.1.2The learnership includes practical work experience of a specified nature and duration.
5.1.3The learnership would lead to a qualification registered by the South African Qualifications Authority and related to an occupation and;
5.1.4The intended learnership is registered with the Director-General in the prescribed manner.

 

5.2Agreements of learnership

 

5.2.1A learnership agreement must be in the prescribed form and registered with the Authority in the prescribed manner.
5.2.2A learnership agreement may not be terminated before the expiry of the period of duration specified in the agreement unless—
5.2.2.1The learner meets the requirements for the successful completion of the learnership or;
5.2.2.2The Authority approves of this termination.
5.2.3The employer or training provider that is a party to a learnership agreement may be substituted with—
5.2.3.1The consent of the learner and:
5.2.3.2The approval of the Authority.
5.2.4The Authority must, in the prescribed manner, provide the Director-General with a record of learnership agreements registered by the Authority.
