34. Taking over administration of the CETA

34.1The Minister may, after consultation with the National Skills Authority, by notice in the Government Gazette in terms of section 15 of the Act , direct the Director-General to appoint an administrator to take over the administration of the CETA if the Minister is of the opinion that—

 

34.1.1The CETA fails to perform its functions;

 

34.1.2There is mismanagement of its finances; or

 

34.1.3Its membership no longer substantially represents the composition contemplated in section 11 of the Act.

 

34.2In that notice the Minister—

 

34.2.1Must determine the powers and duties of the administrator appointed in terms of clause 34.1;

 

34.2.2May suspend or replace one or more members of the CETA for a reason contemplated in clause 34.1;

 

34.2.3May suspend the operation of the Constitution of the CETA; and

 

34.2.4May, in the prescribed manner, transfer funds in the CETAs bank account to the National Skills Fund.

 

34.3If a notice is published in terms of clause 34.1, the Minister may, to ensure that the CETA resumes the performance of its functions—

 

34.3.1Amend its Constitution;

 

34.3.2Reinstate its members; and

 

34.3.3Withdraw or amend any provision of the notice contemplated in clause 34.2 on such conditions as the Minister considers appropriate.
