34.1 | The Minister may, after consultation with the National Skills Authority, by notice in the Government Gazette in terms of section 15 of the Act , direct the Director-General to appoint an administrator to take over the administration of the CETA if the Minister is of the opinion that— |
34.1.1 | The CETA fails to perform its functions; |
34.1.2 | There is mismanagement of its finances; or |
34.1.3 | Its membership no longer substantially represents the composition contemplated in section 11 of the Act. |
34.2 | In that notice the Minister— |
34.2.1 | Must determine the powers and duties of the administrator appointed in terms of clause 34.1; |
34.2.2 | May suspend or replace one or more members of the CETA for a reason contemplated in clause 34.1; |
34.2.3 | May suspend the operation of the Constitution of the CETA; and |
34.2.4 | May, in the prescribed manner, transfer funds in the CETAs bank account to the National Skills Fund. |
34.3 | If a notice is published in terms of clause 34.1, the Minister may, to ensure that the CETA resumes the performance of its functions— |
34.3.1 | Amend its Constitution; |
34.3.2 | Reinstate its members; and |
34.3.3 | Withdraw or amend any provision of the notice contemplated in clause 34.2 on such conditions as the Minister considers appropriate. |
