5. Legal status

The Authority is established in terms of section 41(3) of the Mine Health and Safety Act, (Act No 29 of 1996) and section 9(1) of the Act.

 

5.1The Authority is a juristic person.

 

5.2All actions, suits or other proceedings at law, by or against any committee must be brought by or against the Authority.

 

5.3The Authority may authorise any person or persons to act on behalf of the Authority and to sign all such documents and to take all such steps as may be necessary in connection with any proceedings at law brought by or against the Authority.
