5/1 | Save as otherwise provided in this clause an employer may not require or permit an employee— |
(a) | to work overtime. i.e. time worked outside the hours specified in clause 4 of this Schedule, except in accordance with an agreement between the employer and the employee. |
(b) | to work more than— |
(1) | 3 (three) hours overtime a day; or |
(2) | 10 (ten) hours overtime per week. |
5.2 | No employee shall be dismissed or prejudiced in his/her employment by reason of his/her refusal to work overtime. |
5.3 | Payment for overtime shall be made with the following minimum rates— |
(a) | At the rate of 1 (one) and ½ (one-half) times the hourly salary for each hour or part of an hour so worked on weekdays and, save as is provided in clause 4(3), on Saturdays: Provided that if overtime calculated on a daily basis differs from that calculated on a weekly basis, the basis more favourable to the employee shall be adopted; |
(b) | when an employee works on a Sunday, his/her employer shall either— |
(1) | pay the employee not less than double the remuneration payable in respect of the period ordinarily worked by him/her on a weekday, or double his/her ordinary rate of pay in respect of the total period worked by him/her on such Sunday, whichever is the greater; or |
(2) | by agreement between the employee and employer pay the employee remuneration at a rate not less than 1 (one) and ½ (one-half) times his/her ordinary rate of remuneration in respect of the total period worked on such Sunday and grant him/her within 7 (seven) days of such Sunday, one day's holiday and pay him/her in respect thereof remuneration at a rate not less than his/her ordinary rate of remuneration as if he/she has on such holiday worked his/her average ordinary workings hours for that day of the week. |
