44. Board of control may refund contributions in certain cases

If any practitioner in respect of whom no claim has been made under this Act or in respect of whom such claim has not been sustained, dies or ceases to practise, the board of control may in its discretion, if it is satisfied that no claim is likely to be made, pay to him or his estate a sum not exceeding the aggregate amount of his contributions to the fund made prior to the date of commencement of the Judicial Matters Amendment Act, 2002.
